Who I Am

I am Theresa Truax-Gischler, a registered freelance editor operating in the Netherlands. You may contact me in my capacity as the data controller at theresa(a)nonesuchedit(dot)com.

Legal Grounds for Processing Personal Data You Provide to Me

EU GDPR
The EU’s General Data Protection Regulation (GDPR) imposes obligations regarding “personal data,” which it defines as data relating to an identified or identifiable person (Article 4(1) GDPR). If the individual can be identified only through the use of additional outside information (pseudonymized data), the data is subject to less rigorous restrictions (Article 4(5) GDPR). If the individual can no longer be identified from the data (anonymized data), it is not subject to GDPR provisions (Recital 26 GDPR).

The legal basis within the GDPR for processing your data is the need to perform the services you request or to take necessary steps prior to fulfilling that request (Article 6(1b) GDPR) “performance of a contract”). This basis also applies if you provide me with a service.

The legal basis for processing special categories of personal data such as health, race, sexual orientation, religion, or political beliefs is your explicit consent for me to edit that information (Article 6 (1a) GDPR “consent”).

Why I Process Personal Data You Provide to Me

I collect, store, and use the personal data you provide to me solely for the purposes of running an editing business: so that I may contact you in response to your request for my availability or services; to provide professional editing services to you; to contact you while an editing project is ongoing or to follow up on payment; so that I can issue a quote or invoice for editorial services to you; so that I am compliant with my tax authority should it request an audit. I do not use the personal data you provide to me for marketing purposes.

What Personal Data You Provide to Me

For the purposes of freelance business administration, I collect, store, and use the following personal data that you provide to me: your name, mailing address, email address, and telephone number; the name, VAT and business numbers of your employer if they will be paying for my editing services; a record of my quotation, invoice, and your payment to me (via bank transfer or Stripe) as required by law.

For the purposes of providing professional editing services to you, I also collect, store, and use the following personal data that you provide to me: information pertinent to your request for services (e.g., word count, nature of project); email correspondence about the editing project; the original manuscript/document you wish to have edited and its final edited version.

Personal data, pseudonymized data, or anonymized impersonal data that is part of your social research, contained within your manuscript/document, and for which you are responsible may also include special-category data such as information on health, race, sexual orientation, religion, or political beliefs. I will store and use this data only if you send it to me as part of your manuscript/document for the specific purpose of editing it for research publication.

Who Else Receives the Personal Data You Provide to Me

For administrative purposes, other parties, including my accountant, tax authorities, and the providers of my website and email hosting services, cloud backup system, and banking services, may have access to the personal or impersonal data you provide to me. All of these parties are GDPR-compliant and/or are self-certified under the EU-US Privacy Shield Framework.

How Long I Keep the Personal Data You Provide to Me

I keep personal data that you provide to me for at least ten years in order to comply with tax obligations and for administrative purposes. The relevant tax authorities require me to keep tax records for at least ten years following the end of the year in which the services were provided. All email communications are deleted and purged after ten years.

Your Data Access Rights

You may contact me at any time to request a copy, rectification, or erasure of your personal data. As long as I am complying with legal and tax requirements, I will take action without undue delay and in any event within one month of receipt of the request.

Your Right to Lodge a Complaint

Should you have any concerns about how I process your personal data, please contact me. You also have the right to lodge a complaint with the supervisory authority in the Netherlands where my business is registered or in the country where you live.

A Note on How My Website Uses Cookies

A cookie is a small data file created by a website you visit and stored on your computer or mobile device that enables the website to identify your computer as you view different pages and click on links. Cookies do not provide the website with access to your computer or any personal data about you other than that which you elect to share.
